摘要

2018 年和 2019 年中央一号文件先后对宅基地“三权分置”这一创新性制度给予高度的肯定，宅基地“三权分置”突破原有“两权分离”制度，具有重要的里程碑意义。然而，宅基地“三权分置”之农户资格权作为一种新的权利类型，法律上对于该权利主体没有明确认定，将农户资格权主体认定“户”还是“集体成员”存在较大争议。结合理论与实践，宅基地农户资格权主体认定为“集体成员”具有一定的可行性和必要性。“三权分置”背景下，积极探讨宅基地农户资格权主体是实现乡村振兴战略的重要举措。

Abstract

In 2018 and 2019, the No. 1 Document of the Central Government gave a high degree of affirmation to the innovative system of "separation of three rights" in the homestead. The "three powers separation" of the homestead broke through the original "two rights separation" and it is an important milestone. However, as a new type of rights, the farmer's qualification right in the "separation of three rights" of the homestead is not clearly defined in the law, and there is a big dispute over whether the subject of the farmer's qualification right is "household" or "collective member". Combining theory with practice, there is feasibility and necessity to identify the subject of the farmer's qualification right as a "collective member". Against the background of "the separation of three rights", it is an important measure to realize the rural revitalization strategy by actively exploring the subject of the farmer's qualification right.
